NRATV's Colion Noir has Some Strong Words about Philando Castile's Death

Minutes after Philando Castile was shot by a Minnesota officer, his girlfriend, Diamond Reynolds, sat handcuffed in the back of a patrol vehicle with her weeping 4-year-old daughter. Unlike Reynolds' video, the squad-car video shows the situation's quick escalation and the shooting itself. That left plenty of room for reasonable doubt. After Yanez reached Castile's driver's side window, roughly 30 seconds passed before Yanez fired his weapon. Yanez slowly walked away, and another officer said: "You all right?" A Wisconsin jury on Wednesday cleared a former police officer of first-degree reckless homicide charges in the on-duty shooting of a black man previous year that ignited riots in Milwaukee.

I try not to second-guess jury verdicts in trials I do not watch, as I know from the past decade as a criminal defense lawyer that what the jury sees and hears inside the courtroom is not always the same as what the public sees and hears outside the courtroom.

'I can keep you safe, ' the 4-year-old answer trying to comfort her mother.

Marcell Lenoir, a 24-year-old insurance worker from suburban Brooklyn Center, referred back to testimony that the officer thought Castile resembled a suspected armed robber. In the video, the young girl repeatedly told her mother to keep quiet.

The police video shows the events that occurred immediately prior to the video shot by Castile's girlfriend, Diamond Reynolds, after the shooting, which was broadcast live on Facebook.

Put in context, Yanez' after-the-fact comments about the smell of marijuana seem to imply that the former police officer had completely unwarranted pre-conceived notions about Castile before a gun was mentioned by either party.

Yanez testified that Castile ignored his commands not to pull out his gun and he feared for his life. Yanez's backup officer Joseph Kauser is seen standing on the passenger side of the vehicle. They also released a 30-minute interview conducted with Reynolds by BCA agents hours after the shooting.

NRATV's Colion Noir shared his own opinions on the Castile shooting, and also gave some insight on what it's like to be black in America and an African-American gun owner.

She said the state did not prove that Yanez was being dishonest about seeing a gun.

"Does he know I could just take these bitches off?" she says, referring to the handcuffs, but her daughter again asks her to stay calm. Yanez said, "OK. Don't reach for it then".

It's not clear how having the full interview might have swayed any juror's decision.

Yanez was found not guilty by a jury in Ramsey county District Court Friday on charges of second-degree manslaughter and unsafe discharge of a firearm for his conduct during the July 6, 2016 shooting.

Halberg and Tamburino agreed there were no other lesser charges that prosecutors should have filed that might have carried a better chance of conviction.

"If the officer would've exercised more caution, it may not have escalated as fast", he said. But his office issued a statement calling it "unconscionable and contrary to the pursuit of justice" to suggest that the case should have been charged as a lesser crime.
